European Patent Validation in the Republic of Moldova

The European Patent Office (EPO) and Moldovan State Agency on Intellectual Property (AGEPI) have signed a validation agreement, which will allow European patent applications and patents to take legal effect in the Republic of Moldova.

Under the agreement, applicants will be able to validate their European patent applications and EPO-granted patents in Moldova, even though it is not a contracting state to the European Patent Convention.

Claim for EP validation will incur official fees and will be accompanied with translation of the specification and claims.

Madrid Protocol: change in the Amounts of the Individual Fee in the Republic of Moldova

New individual fees under the Madrid Protocol and the Hague Agreement concerning international applications in the Republic of Moldova will enter into force on May 28, 2011 and June 1, 2011 respectively.

The Director General of WIPO has established the following new amounts of the individual fee: when Moldova is designated in an international trademark application or in a designation subsequent to international registration - 307 Swiss Francs for one class of goods or services and 64 Swiss Francs for each additional class; in respect of the renewal of an international registration -319 Swiss Francs for one class of goods or services and 64 Swiss Francs for each additional class.

An international design application for Moldova will cost 89 Swiss Francs for one design and 9 Swiss Francs for each additional design; the renewal fee for one design will cost 128 Swiss Francs and 13 Swiss Francs for each additional design.

This year we celebrate the starting point of all intellectual property, the seeds from which all innovations and creative works grow – ideas. Mankind’s inexhaustible capacity for producing ideas makes us unique. Yet this extraordinary ability is often taken for granted. We hardly notice the countless ideas we generate every day, or how much of what we value is the fruit of others’ ideas: labor-saving inventions, pleasing designs, life-saving technologies. Ideas shape our world. They are the raw materials on which our future prosperity and heritage depend. This is why it is important to provide environments in which innovative ideas are encouraged and rewarded. This is why intellectual property exists. The International Specialized Exhibition “INFOINVENT-2005”

On November, 9-12 this year on territory of the International Exhibition Center "MOLDEXPO", the IX-th International Specialized Exhibition "INFOINVENT-2005" was held. This event represents an intellectual forum and fair of the inventions, new technologies, technics and materials.

The Exhibition "INFOINVENT" was significant scientific and technical demonstration, not only national, but also the international forum in which took part about 650 exhibitors which presented more of 2700 inventions and cycles of inventions during last 9 years in all priority areas of a science, economy, industry and agriculture, preservation of the environment and biotechnology, medicine and pharmacology, computer engineering and information science etc. The jury of the Exhibition "INFOINVENT-2005" revealed the most actual and perspective scientific and technical achievements and awarded premiums and decorations instituted by organizers of the Exhibition.

The exhibition "INFOINVENT-2005" was held for the first time within the framework of the exhibition forum "CIS: the science intensive products and advanced technologies", provided an opportunity of the scientific and technical community of republic to show to general public and business circles 361 inventions and cycles of the inventions created for the last 5 years. This event was a convenient occasion for establishment of various contacts with the purpose for attraction of the investments destined for implementation of the industrial property, transfer of the IP rights, useful exchange of the scientific and technical information as well as legislative acts in the intellectual property field.

The Exhibition "INFOINVENT-2005" was organized by the Academy of Sciences of Moldova, State Agency on Intellectual Property (AGEPI), Agency on Innovations and Technology Transfer as well as IEC "Moldexpo".

Appreciation of the exhibits and award of premiums for the inventions, utility models, varieties of plants and industrial designs were carried out by the International Jury (the chairman was Mr. Ion Tighineanu, vice-president of the Academy of Sciences of Moldova) and the Commission of experts (the chairman was Mr. Boris Gaina, general scientific secretary of the Academy of Sciences of Moldova) authorized by the decision of the Supreme Council on Science and Technological Development from November 3, this year.

Thus, the Premium "The best inventor of year" of the Government of the Republic of Moldova and the money award at the rate of 5000 Lei won Mr. Ion Bostan academician, rector of the Technical University of Moldova which developed Systems of transformation of kinetic energy of water. The AGEPI Grand Prix and premiums at the rate of 1500 Lei was awarded to Mr. Valerian Dorogan, prof., vice-rector of the Technical University of Moldova for the cycle of inventions in the field of optoelectronics. The Institute of Genetics of the Academy of Sciences of Moldova and Institute of crops "Selection" won in the nomination "The most representative participation at the exhibition". Mrs. Lydia Cherempej (the State university of Medicine and Pharmacy "N.Testemitanu") was entitled "The best inventor of the year among women" for elaboration of new methods of diagnostics of various children's diseases. Ms. Daniela Radu, 16-years old from Romania was entitled "The youngest inventor of year" for the invention of system of glycemia definition as well as indication of medicines prescriptions. The AGEPI premium for "The Best design" was handed to Ms. Elena Postolachi (Institute of Archeology and Ethnography of the Academy of Sciences of Moldova) for utilization, modernization and promotion of national traditions in design of textiles.

The International Salon of inventions and new technologies "New time" from Sevastopol (Ukraine) was awarded with the special diploma for the launch and promotion of innovative activity and a transfer of technologies, but the Romanian State Office for Inventions and Trade marks (OSIM) won the premium for promotion of the intellectual property.

The international Jury and Commission of experts selected the most significant from 361 exhibited inventions (including cycles of inventions) and awarded 17 gold, 37 silver, 30 bronze medals and 49 distinctions. Moreover, there were handed the premium of the Chamber of Commerce and Industry of the Republic of Moldova (2 premiums at rate of 1500 Lei for implementation of the inventions developed by the National Center of Preventive Medicine and Institute of Microbiology of the Academy of Sciences of Moldova), as well as to the Moldavian American company "Biomarketing Group Moldova", to the Forum of the Romanian inventors, to the Association of Inventors of Romania and to the guests from Ukraine.

The awards of the International Salon of Inventions and New technologies "Brusells-EUREKA" (Belgium) and the International Salon of Inventions, New technics and products in Geneva (Switzerland) were handed for the first time this year within framework of exhibition "INFOINVENT". Academician Valeriu Rudic, director of Institute of Microbiology of the Academy of Sciences of Moldova as well as prof. Aurelian Gulea, head of Chair of the State University of Moldova were awarded for special merits and many years promotion the inventions developed in Moldova.

The competition on rewarding by the WIPO Gold medal "Outstanding inventor" and WIPO Trophy "Innovative enterprise" was organized within the framework of the exhibition "INFOINVENT". The commission on rewarding (authorized by the Decision of the Government ¹ 933 from September 12, 2000) awarded the title of the winner of the WIPO Gold Medal to Mr. Stefan Odajiu, the known inventor and businessman, director of the company "Vinex Victoria". The Institute of Chemistry of the Academy of Sciences of Moldova won the WIPO Trophy "Innovative enterprise".

Besides of that, the results of republican competition "The Prize for innovations and creativity" instituted by AGEPI for third time were declared on closing ceremony of the exhibition. The winner of this competition became enterprise EURO-ALCO SRL (in the section "Business, production, rendering of services") and the State University of Moldova (in the section "Scientific researches and higher education"). These organizations possess the most impressive portfolio of industrial property patented/registered in the AGEPI within last 12 months. Diplomas for 1-5 places were awarded accordingly within framework of this exhibition as well.

The winners of competition among the journalists which most actively described the intellectual property topics became Ms. Valentine Malicova (the weekly "Arguments and Facts"). She was awarded the I-st premium at the rate of 1500 Lei. Mr. Dmitry Sidorov (journal "Business of Moldova" was awarded the II-nd premium at the rate of 1000 Lei, Ms.Ana Mutu (Press Agency "Flux" ) was awarded the III-rd premium at the rate of 750 Lei. Others 5 journalists are mentioned by diplomas and incentive prizes. The main criteria of appreciation of the competitors were professionalism and the approach to the topic of the intellectual property protection; profundity and originality of the factual statement; documentary accuracy and citing of sources, knowledge of described area. The seminar on a theme "System of the intellectual property protection in the Republic of Moldova" was organized within the framework of the Exhibition "INFOINVENT-2005".The purpose of this seminar was acquaintance with theoretical and practical aspects and promotion of the intellectual property as well as creation of favorable conditions for cooperation of economic agents with inventors and innovators. The representatives of the exhibitors, students and other interested physical and legal persons took part in this seminar.

More than 80 R&D institutes and universities, the small and middle enterprises and other companies of the Republic of Moldova, Romania and Ukraine presented new elaborations. Taking in consideration that "INFOINVENT" fulfils preliminary selection of the most significant elaborations for future participation at the international exhibitions of inventions in Geneva, Brussels, Pittsburgh, Casablanca, Bucharest, Iasi, Moscow, Kiev, etc., undoubtedly the best of them will be mentioned at these representative forums.

Message from Dr. Kamil Idris, Director General of the World Intellectual Property Organization (WIPO), on World Intellectual Property Day, April 26, 2005.

World Intellectual Property Day is an occasion to reflect on how human creativity and innovation help provide a better world for everyone.

Our message this year, Think, Imagine, Create, is directed particularly towards young people.

Mankind's capacity to create and to innovate is limitless. It is a fundamental, human resource with endless potential. Nowhere is this more apparent than in young people. No matter what country or community they are born into, the young share certain striking characteristics: Their curiosity about whatever is new, different, or novel. Their unfettered imagination. Their readiness to play and experiment - with everyday objects, with ideas, with technology. Their talent for finding unconventional solutions.

Our goal for World Intellectual Property Day and beyond should be to encourage young people everywhere to recognize the creator, the problem-solver, the artist within themselves. For innovation and creativity are the natural resources on which future prosperity depends. From the classrooms of today will come the entrepreneurs, the scientists, the designers, the artists of tomorrow.

BRUSSELS-EUREKA-2004 - The Success of the Moldavian Inventors

On December 24, 2004 in the conference hall of the State Agency on Intellectual Property of the Republic of Moldova (AGEPI) took place the ceremony of awarding the decorations, obtained by the inventors of the Republic of Moldova at the World Exhibition of the Innovation, Research and New technology "Brussels-Eureka-2004" held in the period of November 15-22, 2004.

In the ceremony took part Mr. Marian Lupu, the Minister of Economy, Mr. Gheorghe Duca, President of the Academy of Sciences of Moldova, Mr. Stefan Novac, Director General of AGEPI and persons of science and inventors of the republic. At the edition of the current year the Moldavian inventors presented 12 cycles of inventions, elaborated in 3 institutes of the ASM, 3 Universities and the National Institute of Viticulture and Wine-making. The International Jury appreciated the works of the Moldavian inventors with two gold, six silver and four bronze medals.

Mr. Ion Bostan, academician, rector of TUM and Mr. Nicolae Taran, Doctor Habilitate, Vice-director of the National Institute of Viticulture and Wine-making were decorated with the Gold medal of the European Community for the promotion of the Moldavian inventions at the international exhibitions of inventions. The decoration of the Belgium Kingdom "Meritul Inventiv" was awarded to Mr. Ion Toderas, academician, Director of the Institute of Zoology of ASM - in the grade of Cavaler, and Mr. Andrei Lupasco, prof., TUM, Mr. Gheorghe Nicolau, Prof. SUMPH "N. Testemitanu" - in the grade of Comandor. The organizers of the World Exhibition Brussels-Eureka-2004 awarded the State Agency on Intellectual Property of the Republic of Moldova with a Diploma for promotion and encouragement accorded to the inventors.

The Professor Aurelian Gulea obtained a Prize from the Vice-president of the International Jury, and the academician Valeriu Rudic was awardwed with a Prize of the Poland Academy. On behalf of the ASM and AGEPI the delegation of the Republic of Moldova presented in the frame of the Exhibition a prize of the ASM to the Professor Stanislav Bielecki (Poland), Prize of AGEPI - to the Professor Miron Liviu (Romania) Gold medal of AGEPI - to MRS. Baratov Anatolii (Russia), Cavaleri Toni (Italia), Eduward Dzeciol (Poland). (www.agepi.md)

Use of the official name of the Republic of Moldova

The Government of the Republic of Moldova has taken recently measures concerning the use of the official or historical name of the state in a trademark and/or in a service mark. A Governmental decree adopted the Regulations concerning the order and conditions of licensing for use of the official or historical name of the Republic of Moldova in a trade mark and/or a service mark as well as the Commission's body on examination of the applications for obtaining such licenses and its Regulation. Madrid Protocol: Individual Fees for The Republic of Moldova

In accordance with the decision of the Moldovan Government to receive an individual fee in connection with each international registration in which it is designated and in connection with the renewal of such registration and according to the Rule 35(2)(b) of the Common Regulations under the Madrid Agreement and Protocol were established the following amounts, in SWISS FRANCS, of the individual fee:

Designation fee (in the international application or in a subsequent designation):
- for one class of goods or services - 423
- for each additional class - 35

Renewal fee:
- for one class of goods or services - 353
- for each additional class - 71

The individual fee in respect of the Republic of Moldova takes effect today, December 26, 2003 (www.wipo.org)

The Government of the Republic of Moldova adopted the Regulation regarding the way and the conditions of the permitting to use the official or historical state title in trademarks. The text of the Regulation was published in the Official Bulletin no. 244-247 from December 12, 2003.

Symposium in Mangalia: Counterfeit and Piracy

During the December 3-5, 2003 in Mangalia, Romania took place the Symposium “Prevention and the fight against Counterfeit and Piracy in the context of adhesion of Romania at the European Union”, organized by the Commerce and Industry Chamber of Romania and the National Association for Industrial Property – the Romanian Group of the A.I.P.P.I.

At the works of the symposium participated Dr. Emil Mindicanu, Partner of the FS Patent Agency, member of the International Association for the Protection of the Intellectual Property.

National Intellectual Property Strategy

By the decision no. 1143 of September 18, 2003 the Moldovan Government approved the Development Strategy of the National System of the Protection and Use of Intellectual Property till 2010. The Strategy aim consists in "promotion of coherent policy in the field of intellectual property, compatible with the European Union, C.I.S. and other countries mechanisms, the assurance of the efficient protection of the intellectual property rights and the integration of the national intellectual property system in the economic and social-cultural development of the Republic of Moldova". Anniversary of Moldovan Patent Office

Eleven years have passed since day when AGEPI is on the guard of the industrial property in the Republic of Moldova.

These years the national system of the industrial property protection was created and advanced, also the legislation which is harmonized with standard of international law is adopted. The Republic of Moldova is the participant more than 20 international conventions, treaties and agreements and cooperates with 6 international organizations and the specialized officies about 50 countries of the world. The principal industrial property protection laws and regulations on their application are developed and adopted.

During this period of time thousands of applications for inventions and trademarks are registered. The effective system of registration and promotion of the industrial property objects functions, besides of that the applicants are informed on registration procedure of various industrial property objects in the Republic of Moldova. First of all, this is the Official Bulletin of the Industrial Property (BOPI), issued monthly, the CD-ROM's issued by AGEPI or with its participation as well as the national databases are at disposal of users via Internet, the journal of the inventors and researchers "Intellectus", series of other informational-methodical publications, periodic and advertising publications.

The State Agency on Industrial Property Protection of the Republic of Moldova (AGEPI) was founded by the Decree ¹ 120 dated May 25, 1992. As the state body which is carrying out protection of the industrial property objects, developing methodology and determining the main directions of the internal and foreign policy in question. Intellectual Property Conference in Alushta

At the beginning of the September 2003 in Alushta, the Autonomous Republic of Crimea (Ukraine) it took place the 7-th scientific-practical conference "Actual problems of intellectual property protection". The conference was organized by the State Department of the Intellectual Property of Ukraine in cooperation with WIPO. It was discussed different important subjects of IP protection as for example the strategy of business development using IP rights, commercialization of the IP rights, IP and the small and middle enterprises, development of IP legislation, the protection and use of trademarks, IP and the Internet, legal practice of the IP rights protection, and others.
Dr. Emil Mindicanu, Partner of IP Agency FS Patent Ltd., also attended the conference.

New IP Regulations

In the Moldovan Official Bulletin of Industrial Property no 7/2003 were published the "Regulations regarding the determination of the well-known trademarks". The Regulations were elaborated by the Moldovan Patent Office as a result of the changes in the Law on Trademarks and Appellations of Origin came into force on December 31, 2002. In the same issue of the Official Bulletin were published the "Regulations regarding the evaluation of the intellectual property objects".
